Miss Lambert, welcome to the program, we are now ready to begin, thank you so much and good morning to everybody or good afternoon, I’m on the west coast, so it’s beautiful, I guess technically fall morning and a wonderful time to talk about exempt employees, when it isn’t a wonderful time to talk about exempt employees, so what are we going to cover today?
We’re going to look at this category of ways at the fair labor standard LSA have singled out, first of all, we’re going to look at who is exempt, who is not exempt, who can be exempt, who cannot be exempt, what categories they are exempt.
There are four plus categories, because there are a few iffy ones there, then we have to look at them, if I’m going to claim somebody as exempt, what salary do I have to pay them and how do I handle paying their salary?
What are their job duties in order to qualify to be exempt? Since I’m covering the FLSA, I’ve got to cover the state’s, so where do the state stand? When it comes to exempt employees, where could they differ? Where do they match?
So if you look on slide, you can see the basically lay of the land now, when it comes to the Department of Labor, the first secretary of labor under President Obama was Hilda Solis and she was a staunch pro employee labor secretary.
Before we say, is there an anti employee? No, there’s not the purpose, the Department of Labor is to be an advocate for the employee, that’s their whole purpose, that’s their whole mission, they don’t advocate for the employee or they enforce the laws that protect workers.
So they’re always going to be an advocate for the worker, so her first comments were that we will not rest until the law is followed by every employer and each worker is treated fairly and compensated fairly.
If you think she was tough, the new man that came in Tom Perez is even tougher, when it’s cracking down, especially in the area of exempt employees, this is one of the areas that the Department of Labor federal looks at closely.
