If you haven’t reviewed your EZ Pass statement lately, you might want to take a look, EZ Pass users are suing EZ Pass and the New Jersey Turnpike Authority for fees and fines what they say are over-the-top, they say that the administrative fees that doubled in 2011 to $50 are a money grab.
Administrative fees can be charged for reasons including not updating credit card information, Kathleen Lewis, the director of public affairs for triple-a Northeast has said that fees and fines need to be fair and reasonable, here is Jersey, we used to be charged a little bit, but now it is too much, but it is certainly troublesome, it is certainly problematic and I hope that we get to the bottom of it.
The complaint filed in December in US District Court says that the fee violates both the eighth amendments excessive fines clause and a state law prohibits profiting off ezpass fines, the lawsuit says that the increased fee is being used to generate money that is funneled to the state, these customers want the court to refund hundreds of millions of dollars to the drivers who have been hit with the fee since 2011.
Their lawsuit seeks class-action status, if granted it will automatically include all affected EZ Pass users in any settlement, the allegations can also result in Trenton lawmakers investigating the New Jersey Turnpike Authority, we have reached out to the New Jersey Turnpike Authority for comment and they have not responded, I’m Alison Gorley reporting for JC news.
Thanks Alison Gorley, let’s bring back the eight plus panel to break it down, I am torn on this, you let your credit card expire, you skip a toll, you ought to pay a fine bill, but the problem here is that this is an attorney putting together in a class to sue and for their benefit, that’s what the attorney wants.
I’m not sure if this is necessarily rooted in good law, from what I’ve looked at, a bigger question here is that fines excessive, I don’t know that you can define that in court, we all might think that their excessive is more than five dollars, but people have to pay a fine for stuff, they don’t do that, 50 bucks is not that much when you think about the trucker’s paying a hundred to cross one bridge.
Fifty bucks for a $2 toll might be a mistake or an oversight or you don’t have your transponder, that seems to be an easy ripoff, it’s not an EZ pass, if you agree with me, think about how many people try to scam the tolls, I think the fines are in line, pay your bills and pay attention, it’s simple.
If you don’t skip a toll, you’re not going to get a fine, if you don’t speed, you’re not getting a speeding ticket, if you use your blinker, you’re not going to get a ticket for not using your blinker, if I have got charged, I’ll pay, but it’s a real issue that we’ve got a user fee here and it’s working.
Here’s a bigger question, where is this money going? So we need this money, I’d rather that people aren’t doing what they’re supposed to do, because I don’t want to pay more, but what are we using this money for? I think that it’s going down the same hole, but most of this money goes down and we don’t need to be a whole week of shows answering that question, thanks, it’s good to see you all, thanks for being here.
