I’m Florida Foreclosure defense lawyer Michael Wasylik. I’m in Hillsborough County in Tampa across from the historic Hillsborough County Courthouse. Today I want to talk to you about something that’s happened in the state of New York that involves a Florida lender mortgage servicer.
That might affect many of your cases. It involves the state of New York’s financial regulations and Ocwen Loan Servicing. Many people are affected by Ocwen and many people who have Ocwen as part of their loan mortgage servicing in their mortgage servicing loop rather are going to be affected by this New York State consent order that involves Ocwen.
I’ve written a little bit about it before and I’m going to have a link to some of the things. I’ve written about it including a link to the order itself, but here’s why it’s important. If the records involving your loan have passed through Ocwen are currently being serviced by Ocwen, if the business records as to the principle balances of payment history, as to any of the financial information regarding your loan are being held by Ocwen.
You need to know that they have admitted by entering into this consent order of the state of New York, they’ve admitted that those records are not trustworthy. Let me go back a little bit in history is that for several years now the state of New York has been investigating Ocwen for various servicing abuses.
In other words they are claiming that Ocwen hasn’t been doing a good job, keeping records, taking over records from prior servicers, integrating them and then managing the loans that they’ve taken over servicing form.
As part of that investigation they’ve concluded that despite warning after warning Ocwen still isn’t doing its job in making sure those records are accurate, so what the state of New York has done is that they’ve introduced incent order that Ocwen is agreed to have their processes supervised by somebody picked by the state of New York.
In turn they they’ve admitted that their processes, their internal systems are inadequate to ensure that their records are accurate. How does this affect you? When you’re going into court, when you’ve got a foreclosure case, and the evidence against you is being held, as being managed by Ocwen or has passed through Ocwen and has gone on to another service or if Hawkwood sold the loan, the records are being introduced into your case.
In order to introduce business records, part of the court evaluation to determine whether or not those records can be admitted is whether or not they’re trustworthy. If the keeper of those records has admitted to a state regulatory agency that their records are not reliable and not accurate, their systems are not adequate, make sure that they’re trustworthy than their suspect and they can’t be admitted under Florida’s evidence code.
If a business record is not trustworthy, it should not be admitted. If Ocwen has signed off on a consent order saying we admit, our records are not properly kept, our records are not reliable, our records are not accurate, our records are not trustworthy and our systems in place are not sufficient to guarantee that they are trustworthy, that’s what the consent order says like a paragraphs for 14, 15, 16.
When you have that, you have a very important tool in making sure those records he kept out, because they’re not reliable, they’re not trustworthy and they shouldn’t be admitted as evidence in any Florida Court.
When Ocwen has your loan, if the records have passed through and have gone on to another service circuit, there’s no way for subsequent servicers to evaluate whether or not those records are accurate.
